CASE OF NICHOLAS v. CYPRUS

In terms of the said judgement, lawyers are obliged to disclose at the outset of the proceedings if the relatives of the presiding judge, works in their law firm.

An assessment should be made taking into account the various factors involved, in order to determine whether disqualification is actually necessitated in the case.
