Following the enactment of Act XIX of 2021, the Legal Profession (Reform) Act, the Committee for Advocates and Legal Procurators has set-up a Register of Legal Professionals and Law Firms in fullfilment of the requirements of the law.
Advocates
In terms of Article 79 of Chapter 12 of the Laws of Malta, no person may exercise the profession of advocate unless duly admitted to the aforementioned Register.
In this respect the Committee for Advocates and Legal Procurators is inviting all persons who are in possession of a warrant to practice as advocate to immediately apply to be included in the Register of Legal Professionals and Law Firms in fulfilment of the aforementioned obligation. Applications are to be submitted via the form attached to this link https://form.jotform.com/220884507193359 which may also be accessed from https://digitaljustice.gov.mt
In line with the provisions of Act XIX of 2021, the Committee shall publish the names and surnames of the warranted legal professionals who apply to have their names registered in the Register for Legal Professionals and Law Firms, whereas all other data requested in the attached form shall be so published in so far as consent for such publication is granted by you on the said form.
In the event that you have recently received/will receive an email requesting that the data held by Department of Justice in the Lawyers’ Register set-up by the Department in 2019 be transferred to the Committee for Lawyers and Legal Procurators and you have consented to such transfer pursuant to said email, you are not required to re-submit your application to be included in the Register of Legal Professionals and Law Firms.
Law Firms
In terms of Article 88A of Chapter 12 of the Laws of Malta no partnership or association of persons or other legal entity, howsoever formed and called, shall act or hold itself out as being a law firm and no person shall be entitled, recognised or authorised to act in the name and on behalf of a law firm unless and until it has been duly registered in the aforementioned Register. In respect of law firms already in existence, said Article 88A provides that such law firms must be so registered in the said Register within 12 months from the coming into force of Act XIX of 2021, that is by the 20th April 2022, and following such date no person shall be entitled, recognised or authorised to act in the name and on behalf of an unregistered law firm.
In this respect the Committee for Advocates and Legal Procurators is inviting all law firms to immediately apply to be included in the Register of Legal Professionals and Law Firms in fulfilment of the aforementioned obligation. Please note that failure to comply with one’s obligation to apply to be included in the Register of Legal Professionals and Law Firms shall on conviction result in the imposition of such fines and/or imprisonment for such term as stipulated by law.
