The Malta Law Academy will be hosting a lecture by Dr Ivan Mifsud, Dean of the Faculty of Laws, entitled: “Chapter II of the Constitution of Malta: Any Legal Significance?”
Chapter II of the Maltese Constitution consists of a declaration of principles, which the Maltese Legislature is required to uphold during the course of its work, but are ‘non justiciable’. A lot of questions surround this chapter namely:
Why was it included in the first place? What purpose does it serve? Has it proven effective ? How have our courts regarded this chapter? Could the courts have done better in interpreting and upholding this chapter? In terms of content, are the listed principles relevant sixty years on? Should they be updated and if so how? Could we do better by just scrapping chapter II?
In the process of questioning Chapter II, the lecturer will offer suggestions on the way forward.
The event is being organised by the Malta Law Academy, in collaboration with the Faculty of Laws and the Malta Chapter of the International Society of Public Law within the said Faculty.
